This Privacy Policy explains how MGK LLC, doing business as "Breeze Captain" ("Breeze Captain," "we," "us," or "our"), collects, uses, and shares information when you visit our websites, including https://breezecaptain.com (the "Site"), or submit a request through them. By using the Site, you agree to this Policy.
1. About Breeze Captain
Breeze Captain is a marketing and referral service that connects homeowners and other consumers with independent, third-party HVAC contractors and service providers ("Service Providers"). We are not an HVAC contractor and do not perform home services. When you submit a request, our core function is to share your information with one or more Service Providers so they can contact you about your request.
2. Information We Collect
Information you provide. When you submit a form, request a quote, or contact us, we collect the information you give us, which may include your name, telephone number, email address, street or service address, property and project details, and the nature of the HVAC service you are seeking.
Information collected automatically. When you use the Site, we and our service providers may automatically collect your IP address, device and browser type, pages viewed, referring URLs, and interactions with the Site, using cookies and similar technologies. If you call a tracked telephone number, we may collect call details and, where permitted by law, record calls for quality, training, and verification.
Information from third parties. We may receive information about you from advertising platforms, analytics providers, and marketing partners, and combine it with information we collect.
3. How We Use Your Information
We use the information we collect to:
- connect you with one or more Service Providers and facilitate their contact with you;
- operate, maintain, secure, and improve the Site and our services;
- communicate with you, including by phone, text, and email, about your request and our services;
- measure and improve our advertising and marketing, including retargeting;
- detect and prevent fraud, abuse, and security incidents; and
- comply with legal obligations and enforce our terms.
4. How We Share Your Information
With Service Providers. Our primary purpose is to share the details of your request — including your name and contact information — with one or more independent HVAC Service Providers so they can respond to you. Those Service Providers are independent businesses and use your information under their own privacy practices, for which we are not responsible.
With our vendors and processors. We share information with companies that perform services for us, such as website hosting, call tracking, customer-relationship and lead-distribution platforms, analytics, email and SMS delivery, and payment processing.
With advertising and analytics partners. We may share online identifiers and usage information with advertising and analytics partners (such as Google and Meta) to deliver and measure advertising.
For legal and business reasons. We may disclose information to comply with law, respond to lawful requests, protect our rights and the safety of others, or in connection with a merger, acquisition, financing, or sale of assets.
"Sale" or "sharing" under state law. Because we share consumer contact information with Service Providers and use advertising partners, our practices may be considered a "sale" or "sharing" of personal information under certain state privacy laws. You can opt out as described in Section 7.
5. Communications and Your Consent
When you submit your information, you consent to be contacted by us and by one or more Service Providers at the contact details you provide, including by phone call, text message, and email, and including automated technology and prerecorded messages, even if your number is on a Do-Not-Call list. Consent is not a condition of purchase. You may opt out of marketing emails using the unsubscribe link, opt out of text messages by replying STOP, and request not to be contacted by emailing info@breezecaptain.com. Message and data rates may apply.
6. Cookies and Tracking Technologies
We and our partners use cookies, pixels, and similar technologies to operate the Site, remember your preferences, measure performance, and support advertising. You can control cookies through your browser settings and may opt out of certain advertising cookies through industry tools such as the Digital Advertising Alliance. Where required, we honor browser-based opt-out signals such as Global Privacy Control (GPC).
7. Your Privacy Rights
Depending on where you live, you may have rights under laws such as the California Consumer Privacy Act (as amended by the CPRA) and similar state laws, including the right to: know or access the personal information we hold about you; request deletion or correction of that information; opt out of the "sale" or "sharing" of your personal information and of targeted advertising; and not be discriminated against for exercising your rights.

8. Do Not Sell or Share My Personal Information
If you would like to opt out of the "sale" or "sharing" of your personal information as those terms are defined under applicable state law, email info@breezecaptain.com with the subject line "Do Not Sell or Share," or use any opt-out mechanism we provide on the Site. We also honor Global Privacy Control (GPC) signals where required.
9. Data Retention
We retain personal information for as long as needed to fulfill the purposes described in this Policy, including to connect you with Service Providers, operate our business, comply with legal obligations, resolve disputes, and enforce our agreements, after which we delete or de-identify it.
10. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
11. Children's Privacy
The Site is intended for adults and is not directed to children. We do not knowingly collect personal information from anyone under 18. If you believe a child has provided us information, contact us and we will delete it.
12. Third-Party Links
The Site may link to third-party websites, including those of Service Providers. We are not responsible for the privacy practices of those third parties, and we encourage you to review their privacy policies.
13. Changes to This Policy
We may update this Privacy Policy from time to time. We will post the updated version with a new effective date, and your continued use of the Site after the changes take effect constitutes acceptance.
